Residential And Commercial Construction Contracts

Construction works need to be carried out every now and then by the common people as well as different business firms. Mostly the legal contracts for construction work are signed mostly when significant amount of work is required to be done on the construction site. Construction contracts are very similar in nature to normal contracts, as they are nothing but an agreement in which all the parties involved decide about the obligations and rights of each other with objective of completion of the construction work required.

Legally there is no difference between the two, but practically the construction contracts could be divided in two main categories Residential construction contracts and commercial construction contracts and names itself are enough to tell you the target type of construction under each contract.

Legal construction contract makes the parties liable for their role in the project, simply speaking it forces the construction firm to fulfill the construction work that is expected from it and from the contractor it is expected to pay the firm justly as decided in the contract. Furthermore the construction contract contains the details of the parties involved in the project. If the contract is done with a company or at both the ends there are companies than legally appointed representatives' details are also mentioned. Cost of the project and different milestones set for the payments are also very important aspect of a construction contract.

So we can see from building a sky scrapper to ordinary renovation all can be outlined in a construction contract. The details of the content vary based on scope of the project and kind of finances and parties involved in the work. Bare minimum requirement of a residential construction contract is the project scope to determine what exactly needs to be done under the contract. More details are there for the scope, even better it is for all the parties to not end up fighting over some dispute. Contract must be prepared to include any imaginable detail so that all parties are on same page since initiation of the project.

If a person does not find himself/herself equipped enough to understand the technical and complex language of the contract, expert help must be taken. Residential contracts also contains the duration of the project including the major milestones. Payments are also generally associated with the completion of certain milestones. So putting them all in the contract is very helpful to see the project completion without any dispute.

Commercial construction contracts are more details oriented due to high finances involved and presence of more than two parties in most of the cases. In fact, more disputes are raised in the commercial constructions as compare to the residential constructions. In addition to the details mentioned for a residential contract, a commercial contract contains the additional information like supply chain cycle details, legal coverage, backup strategy, change management plan, exit criteria, completion criteria (success criteria) to name a few. Basically, the commercial contracts are more professional due to legal requirements.
